Please read these Terms and Conditions carefully before using the Taplings website (taplings.com) or purchasing any Taplings products. By accessing our website or making a purchase, you agree to be bound by these terms.

1. About Taplings

Taplings is a collectible character brand selling physical NFC-enabled keychain products. References to “Taplings”, “we”, “us”, or “our” refer to the Taplings brand and its operators.

2. Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the website in any way that violates applicable local, national, or international law or regulation.
  • Transmit any unsolicited or unauthorised advertising material.
  • Attempt to gain unauthorised access to any part of the website or its related systems.

3. Products and Pre-Orders

Taplings products are currently in a pre-launch phase. By joining our early-access list, you are not entering a purchase contract. When products become available for purchase:

  • All product descriptions, images, and specifications are provided as accurately as reasonably possible but may vary slightly from the final product.
  • Prices are displayed inclusive of applicable taxes and exclusive of shipping unless stated otherwise.
  • We reserve the right to refuse or cancel any order at our discretion.
  • A contract of sale is formed only upon our confirmation of dispatch.

4. NFC Technology

Each Taplings product includes a built-in rewritable NFC tag. By purchasing a Taplings product, you acknowledge:

  • The NFC tag is provided as-is. You are responsible for programming the destination URL.
  • We are not responsible for the content, availability, legality, or security of any destination URL, website, file, or other resource programmed onto an NFC tag by you or another user.
  • The NFC tag may be reprogrammed using widely available third-party NFC writing apps.

5. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, images, character designs (including Skully), and the Taplings brand — is the intellectual property of Taplings and is protected by copyright and trademark law.

You may not reproduce, distribute, or create derivative works from our content without prior written permission.

6. User Content

If you submit content to us (e.g., via contact forms or social media tags), you grant us a non-exclusive, royalty-free licence to use, display, and share that content in connection with our marketing and brand activities.

7. Limitation of Liability

To the fullest extent permitted by law, Taplings shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products.

Our total liability to you shall not exceed the amount you paid for the relevant product or service.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

9. Changes to These Terms

We may update these Terms and Conditions at any time. The current version will always be available on this page. Continued use of our website or services after changes constitutes acceptance of the updated terms.

This section covers the Taplings mobile app specifically, in addition to the website terms above.

About Taplings App

The Taplings app is part of the Taplings platform and enables users to read and write compatible NFC tags included with Taplings products.

Acceptable Use

Use the app in compliance with applicable laws. Do not use it to write content that is illegal, harmful, or infringes on the rights of others. You agree not to use the app or Taplings products for unlawful, fraudulent, abusive, deceptive, or harmful purposes. You are solely responsible for what you write to a tag and for how you and others use and interact with your Taplings — Taplings is not responsible for that use or interaction.

NFC Technology

You are solely responsible for any content programmed onto an NFC tag using the Taplings app or any third-party NFC writing application. Taplings does not review, monitor, verify, or control the content stored on NFC tags and is not responsible for the availability, legality, accuracy, security, or consequences of any URLs, websites, files, encrypted data, or other information written to a tag by you or another user. The Taplings app does not transmit the contents of NFC tags to Taplings or third parties. Any information retained by the app, including local reading history or other locally stored records, remains on the user's device unless the user chooses to share it.

Limitation of Liability

The app is provided as-is. To the extent permitted by law, Taplings is not liable for indirect or consequential damages arising from use of the app.

Platform Availability

The Taplings app is designed to work across supported mobile platforms. At launch, the app is available on Android through Google Play. Support for additional platforms, including iOS, may become available in future releases. Features and functionality may vary depending on the operating system and app version.

Device Permissions

The Taplings app may request access to certain device features, such as NFC, solely to provide its intended functionality. Any permissions requested are used only for the features they support.

Future Features

Certain features described in these Terms may evolve over time. Future versions of the Taplings app may introduce optional user accounts, cloud services, or additional functionality. These Terms will be updated accordingly if those features are introduced.
